Work with experienced attorney to seek appropriate damages for brain injury, P.2

In our previous post, we began discussing the importance of seeking appropriate medical care for brain injuries caused by motor vehicle accidents, and of gathering the best possible evidence to ensure appropriate damages may be sought in court. Here, we'll look briefly at several categories of damages brain injury victims are likely to seek out in personal injury cases.

First of all, those who suffer serious brain damages in motor vehicle accidents very often experience a diminished ability to support themselves and their family. Taking time off work is a given, and those who suffer a serious head injury may have to quit their job or career altogether, either to take a job that better suits their diminished work capacity or to receive necessary care. Seeking damages for lost earnings and lost earning capacity is, therefore, a must.

Another important types of damages in brain injury cases is medical bills, including lifelong medical care. Unlike some types of motor vehicle accident injuries, brain injury can have long-term consequences, and these can be costly. Seeking appropriate damages is more than just a matter of looking to the next year or two of costs. It must involve careful calculation of the lifetime costs associated with brain injury.

Noneconomic damages such as pain and suffering, loss of enjoyment of life, and so on, are also important in brain injury cases. In fact, they can be critical to focus on when the accident victim does not, for one reason or another, stand to gain a sufficient amount of economic damages.

In any damages case, credible medical expert testimony plays a critical role, as does the testimony of damages experts. An experienced attorney, of course, understands how to build the best possible case and to advocate for the interests of accident victims to give them the best possible chance of maximizing their damages recovery.
